Who owns rights to a script, if?

Question by Skyline: Who owns rights to a script, if?
I had an idea for the website, and found a programmer who did the script for me, for a fee, now he wants to sell it on his own and make big bucks on it, so who does own the rights to it?
it was a brand new idea, I just asked him to do it for me and he did it, I never just thought he would resale it, and if he would sell it, all profits to him, but Im going to resale it too, after I get traffic on my site, I just dont want any competition!!!!!
and we never discussed any details of it, package will go for about 5000$ a piece!
thanks for the answers, I just wanted to know what Im in for and what I can demand by the law, but he’s still a cool programmer. I can not post that script right now, since we working on details right now, and just the issue of resaling it poped up recently, and like I said I dont want any competition right now from small fish, I already have yahoo as a competitor, and Im going to take my idea and concept with numbers to Microsoft, and have them do the rest, and I will get a fat check :)))))

that depends on the deal that was made…..if no rights to the software was dicussed then it should go to you , as a customer you ordered a product and got it made…

If this is more of a service where they have the software already and just customized it for your puposes then you;re stuck , they own it…
